Terms of Service

Please read these Terms carefully before using TradeDeck. By creating an account or placing an order, you confirm that you have read and agreed to these Terms.

1. Acceptance of Terms

By accessing or using TradeDeck (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

These Terms form a legally binding agreement between you and TradeDeck (operated by Pmap Group, a company incorporated in Nigeria). We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

These Terms must be read together with our Privacy Policy, which is incorporated herein by reference.

2. Use of Service

You must be at least 18 years old to create an account on TradeDeck. By registering, you confirm you meet this requirement.

You agree to: - Provide accurate, current, and complete information during registration - Keep your login credentials confidential and notify us immediately of any unauthorised access - Use the Platform only for lawful purposes and in compliance with Nigerian law - Not use automated tools, scrapers, or bots to access or collect data from the Platform without our written consent - Not engage in any activity that disrupts, damages, or interferes with the Platform

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

3. Seller Responsibilities

By registering as a seller, you represent and warrant that:

  • You are the rightful owner or authorised distributor of all products you list
  • Your products are genuine, not counterfeit, and comply with all applicable Nigerian standards (NAFDAC, SON, etc.)
  • You have the necessary licences and permits to sell the listed products
  • Your product descriptions, prices, and images are accurate and not misleading
  • You will fulfil confirmed orders promptly and as described

Sellers are prohibited from listing: - Counterfeit, pirated, or stolen goods - Illegal substances, weapons, or controlled items - Products that violate third-party intellectual property rights - Any item whose sale is prohibited under Nigerian law

TradeDeck charges a 3% commission on completed sales. This fee is deducted automatically before seller payouts. Listing products is free.

We reserve the right to remove any listing that violates these Terms or our content policies, and to suspend seller accounts with repeated violations.

4. Buyer Responsibilities

As a buyer, you agree to:

  • Provide accurate delivery information for each order
  • Make payment promptly upon order confirmation
  • Inspect goods upon delivery and raise any disputes within 48 hours of confirmed delivery
  • Not make fraudulent claims, chargebacks, or dishonest dispute filings

Buyers may not use the Platform to: - Purchase goods for resale in violation of a seller's listed terms - Harass, threaten, or abuse sellers or TradeDeck support staff - Engage in collusive behaviour designed to defraud sellers

TradeDeck holds payment in escrow until delivery is confirmed. If you do not raise a dispute within 48 hours of delivery confirmation, funds are released to the seller.

5. Payments & Fees

All payments on TradeDeck are processed in Nigerian Naira (NGN) through licensed payment partners including PechPay.

For buyers: The price displayed at checkout is the final price including applicable VAT (7.5%). Delivery fees are calculated at checkout based on location and item weight.

For sellers: TradeDeck deducts a 3% transaction fee from each successful sale before releasing funds to your PechPay wallet or linked bank account. Payouts are processed within 2 business days of delivery confirmation.

Refunds: Approved refunds are processed within 5–10 business days to your original payment method. PechPay wallet refunds are instant.

TradeDeck uses escrow to protect both parties. Funds are only released to the seller once the buyer confirms delivery or the 48-hour dispute window expires without a claim.

6. Intellectual Property

All content on TradeDeck — including the TradeDeck name, logo, design, software, and written content — is the intellectual property of Pmap Group and protected under Nigerian copyright and trademark law.

You may not reproduce, distribute, modify, or create derivative works from any TradeDeck content without our express written permission.

By uploading product images, descriptions, or other content to TradeDeck, you grant us a non-exclusive, royalty-free, worldwide licence to display and use that content for the purpose of operating and promoting the Platform. You retain ownership of your content.

If you believe your intellectual property rights have been infringed on our Platform, contact legal@tradedeck.ng with details of the alleged infringement.

7. Disclaimers & Limitation of Liability

TradeDeck is a marketplace platform. We facilitate transactions between buyers and sellers but are not a party to the sale contract between them.

We do not guarantee: - The quality, safety, or legality of any listed product - That sellers will fulfil orders as described (though we take action when they do not) - Uninterrupted or error-free access to the Platform

To the fullest extent permitted by Nigerian law, TradeDeck's total liability to you for any claim arising from use of the Platform shall not exceed the value of the transaction giving rise to the claim, or ₦50,000 (whichever is lower).

Nothing in these Terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.

8. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any dispute arising from these Terms or use of the Platform shall first be referred to our internal dispute resolution team. If unresolved within 14 days, disputes shall be submitted to mediation before the Lagos Multi-Door Courthouse (LMDC) or, if mediation fails, to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

If you are a consumer, you may also have rights under the Federal Competition and Consumer Protection Act (FCCPA) 2018 and may refer complaints to the Federal Competition and Consumer Protection Commission (FCCPC).
